Article L531-40 of the French Code governing the entry and residence of foreign nationals and the right of asylum

If, within less than nine months of the decision to close the file taken pursuant to articles L. 531-37 or L. 531-38, the asylum seeker requests that the file be reopened or submits a new application, the French Office for the Protection of Refugees and Stateless Persons will reopen the file and resume examination of the application at the stage at which it was interrupted. The applicant’s request to reopen his or her file is a compulsory prerequisite for lodging an appeal with the administrative courts under ordinary law, failing which the appeal will be inadmissible.
An applicant’s file may only be reopened once pursuant to the first paragraph.
After the nine-month period has elapsed, the decision to close the file is final and the new application is considered to be a request for reconsideration.

Article L531-40

Si, dans un délai inférieur à neuf mois à compter de la décision de clôture prise en application des articles L. 531-37 ou L. 531-38, le demandeur d’asile sollicite la réouverture de son dossier ou présente une nouvelle demande, l’Office français de protection des réfugiés et apatrides rouvre le dossier et reprend l’examen de la demande au stade auquel il avait été interrompu. Le dépôt par le demandeur d’une demande de réouverture de son dossier est un préalable obligatoire à l’exercice d’un recours devant les juridictions administratives de droit commun, à peine d’irrecevabilité de ce recours.
Le dossier d’un demandeur ne peut être rouvert qu’une seule fois en application du premier alinéa.
Passé le délai de neuf mois, la décision de clôture est définitive et la nouvelle demande est considérée comme une demande de réexamen.
