In the cases referred to in Articles L. 5312-1 and L. 5312-2, and in the event of suspension or withdrawal of authorisation or registration of a product or group of products referred to in Article L. 5311-1, the Agency may order the natural or legal person responsible for placing the product on the market, putting it into service, making it available on the market or using it to withdraw the product or group of products from any place where it is found, to destroy it when this is the only way of putting an end to the danger, and to order the dissemination of warnings or precautions for use. These measures are the responsibility of the person concerned.
Where appropriate, measures to suspend, ban, withdraw or destroy a product may be limited to certain production batches.
Any manufacturer, importer, transporter, wholesale or retail distributor who has acquired or disposed of the batches concerned and who is aware of the decision is required to inform those who have supplied the goods and those to whom they have disposed of them.
