Article L532-36 of the French Monetary and Financial Code

I. – The manager’s authorisation is granted by the Autorité des marchés financiers (AMF) under the conditions set out in article L. 532-9 and in accordance with the AMF General Regulation.

II. – If the competent authorities of a reference Member State other than France do not comply, within a reasonable time, with the required terms of cooperation stipulated in 2° of Article L. 532-29, the Autorité des marchés financiers may refer the matter to the European Securities and Markets Authority.

Where the Autorité des marchés financiers disagrees with the decision on authorisation taken by the competent authorities of a reference Member State other than France, it may refer the matter to the European Securities and Markets Authority.

Article L532-36

I. – L’agrément du gestionnaire est octroyé par l’Autorité des marchés financiers dans les conditions mentionnées à l’article L. 532-9 et dans celles prévues par le règlement général de l’Autorité des marchés financiers.

II. – Si les autorités compétentes d’un Etat membre de référence autre que la France ne respectent pas, dans un délai raisonnable, les modalités requises de coopération prévues au 2° de l’article L. 532-29, l’Autorité des marchés financiers peut saisir l’Autorité européenne des marchés financiers.

Lorsque l’Autorité des marchés financiers est en désaccord avec la décision sur l’agrément, prise par les autorités compétentes d’un Etat membre de référence autre que la France, elle peut saisir l’Autorité européenne des marchés financiers.
