Article L533-16 of the French Monetary and Financial Code

Articles L. 533-11 to L. 533-15 apply taking into account the nature of the service offered or provided, the nature of the financial instrument in question, and the professional or non-professional nature of the client, particularly the potential client.

A professional client is a client who has the experience, knowledge and skills necessary to make his own investment decisions and properly assess the risks involved.

A decree specifies the criteria according to which clients are considered to be professional or non-professional and the conditions and procedures according to which non-professional clients may request to be treated as professional clients.

Les articles L. 533-11 à L. 533-15 s’appliquent en tenant compte de la nature du service proposé ou fourni, de celle de l’instrument financier considéré, ainsi que du caractère professionnel ou non du client, notamment du client potentiel.

Un client professionnel est un client qui possède l’expérience, les connaissances et la compétence nécessaires pour prendre ses propres décisions d’investissement et évaluer correctement les risques encourus.

Un décret précise les critères selon lesquels les clients sont considérés comme professionnels ou non professionnels et les conditions et modalités selon lesquelles les clients non professionnels peuvent demander à être traités comme des clients professionnels.
