Article L541-3 of the French Code governing the entry and residence of foreign nationals and the right of asylum

Without prejudice to the provisions of articles L. 753-1 to L. 753-4 and L. 754-1 to L. 754-8, where a foreign national applying to register an asylum application has, prior to the submission of his application, been the subject of a removal decision taken pursuant to Book VI, the latter may not be enforced as long as the foreign national benefits from the right to remain on French territory, under the conditions provided for in articles L. 542-1 and L. 542-2.

Sans préjudice des dispositions des articles L. 753-1 à L. 753-4 et L. 754-1 à L. 754-8, lorsque l’étranger sollicitant l’enregistrement d’une demande d’asile a fait l’objet, préalablement à la présentation de sa demande, d’une décision d’éloignement prise en application du livre VI, cette dernière ne peut être mise à exécution tant que l’étranger bénéficie du droit de se maintenir sur le territoire français, dans les conditions prévues aux articles L. 542-1 et L. 542-2.
