Article L5411-3 of the French Public Health Code

As part of this mission, the inspectors referred to in article L. 5411-1 may seize products on the basis of a judicial authorisation issued by an order of the liberty and custody judge. The request must include all the information required to justify the seizure. The seizure is carried out under the authority and control of the judge who authorised it.

The products seized are immediately inventoried. The inventory is attached to the on-the-spot report. The originals of the report and the inventory are sent to the judge who ordered the seizure within five days of their completion.

The liberty and custody judge may, at any time, order the release of the seizure.

Dans le cadre de cette mission, les inspecteurs mentionnés à l’article L. 5411-1 peuvent procéder à la saisie de produits sur autorisation judiciaire prononcée par ordonnance du juge des libertés et de la détention. La demande doit comporter tous les éléments d’information de nature à justifier la saisie. Celle-ci s’effectue sous l’autorité et le contrôle du juge qui l’a autorisée.

Les produits saisis sont immédiatement inventoriés. L’inventaire est annexé au procès-verbal sur les lieux. Les originaux du procès-verbal et de l’inventaire sont transmis, dans les cinq jours qui suivent leur clôture, au juge qui a ordonné la saisie.

Le juge des libertés et de la détention peut, à tout moment, ordonner la mainlevée de la saisie.
