Article L5412-1 of the French Public Health Code

In the premises, places, installations and vehicles to which they have access pursuant to article L. 1421-2, as well as in public places, the Agency’s inspectors, authorised and sworn under the conditions laid down by decree in the Conseil d’Etat, are authorised to investigate and record breaches of the laws and regulations relating to the activities and products mentioned in article L. 5311-1 as well as the provisions of Title II of Book I of the Consumer Code when the breach relates to one of these products.

The provisions of articles L. 1421-3, L. 5411-2, L. 5411-3 and L. 5411-4 are applicable to the exercise of this mission.

Article L5412-1

Dans les locaux, lieux, installations et véhicules auxquels ils ont accès en application de l’article L. 1421-2, ainsi que dans les lieux publics, les inspecteurs de l’agence habilités et assermentés dans des conditions fixées par décret en Conseil d’Etat ont qualité pour rechercher et constater les infractions aux lois et règlements relatifs aux activités et aux produits mentionnés à l’article L. 5311-1 ainsi qu’aux dispositions du titre II du livre Ier du code de la consommation lorsque l’infraction porte sur un de ces produits.

Les dispositions des articles L. 1421-3, L. 5411-2, L. 5411-3 et L. 5411-4 sont applicables à l’exercice de cette mission.
