Article L5421-6 of the French Public Health Code

Failure to comply with the obligation to inform the Agence nationale de sécurité du médicament et des produits de santé (French National Agency for the Safety of Medicines and Health Products) of the cessation of marketing of a medicinal product in another State and failure to inform it of the reason for this cessation of marketing pursuant to article L. 5121-9-4 is punishable by two years’ imprisonment and a fine of €150,000.

Le fait de ne pas respecter l’obligation d’informer l’Agence nationale de sécurité du médicament et des produits de santé de l’arrêt de la commercialisation d’un médicament dans un autre Etat et de ne pas lui communiquer le motif de cet arrêt de commercialisation en application de l’article L. 5121-9-4 est puni de deux ans d’emprisonnement et de 150 000 € d’amende.
