Article L5426-1-1 of the French Labour Code

I.-Periods of employment lasting more than three days, consecutive or otherwise, during the same calendar month, which are not declared by the jobseeker to Pôle emploi by the end of that month, are not taken into account for the purpose of opening or topping up insurance benefit entitlements. Remuneration corresponding to periods not declared is not included in the reference salary.

II -Without prejudice to the right of the jobseeker to lodge an application for judicial or administrative review, where the application of I of the present article is an obstacle to the opening or to the topping up of insurance allowance rights, the jobseeker may refer the matter to the Pôle emploi joint body referred to in Article L. 5312-10.

I.-Les périodes d’activité professionnelle d’une durée supérieure à trois jours, consécutifs ou non, au cours du même mois civil, non déclarées par le demandeur d’emploi à Pôle emploi au terme de ce mois ne sont pas prises en compte pour l’ouverture ou le rechargement des droits à l’allocation d’assurance. Les rémunérations correspondant aux périodes non déclarées ne sont pas incluses dans le salaire de référence.

II.-Sans préjudice de l’exercice d’un recours gracieux ou contentieux par le demandeur d’emploi, lorsque l’application du I du présent article fait obstacle à l’ouverture ou au rechargement des droits à l’allocation d’assurance, le demandeur d’emploi peut saisir l’instance paritaire de Pôle emploi mentionnée à l’article L. 5312-10.
