Article L5426-1 of the French Public Health Code

I.-The act or attempt to distribute or transfer, free of charge or for a consideration, gene therapy preparations or xenogenic cell therapy preparations without authorisation or when authorisation is suspended or withdrawn is punishable by five years’ imprisonment and 375,000 €.

II – The same penalties apply to the act or attempted act of:

1° Importing or exporting gene therapy preparations or xenogenic cell therapy preparations without the authorisation referred to in Article L. 5124-13 ;

2° Preparing, storing, distributing, transferring, importing or exporting these same products without holding the authorisations provided for in articles L. 4211-8 and L. 4211-9.

III. – The penalties referred to in I and II are increased to seven years’ imprisonment and a fine of €750,000 when :

1° The offences referred to in the first paragraph have been committed as part of an organised gang ;

2° These same offences were committed on a telecommunications network intended for a non-specified public;

3° These same offences were committed by pharmaceutical establishments authorised in accordance with article L. 5124-3, brokers declared in accordance with article L. 5124-20, dispensing pharmacists holding the licence referred to in article L. 5125-4 and in-house pharmacists referred to in article L. 5126-5 of the same code.

Article L5426-1

I.-Le fait ou la tentative de distribuer ou céder à titre gratuit ou onéreux des préparations de thérapie génique ou des préparations de thérapie cellulaire xénogénique sans autorisation ou lorsque l’autorisation est suspendue ou retirée est puni de cinq ans d’emprisonnement et de 375 000 €.

II.-Est puni des mêmes peines le fait ou la tentative :

1° D’importer ou d’exporter des préparations de thérapie génique ou des préparations de thérapie cellulaire xénogénique sans l’autorisation mentionnée à l’article L. 5124-13 ;

2° De préparer, de conserver, de distribuer, de céder, d’importer ou d’exporter ces mêmes produits sans être titulaire des autorisations prévues aux articles L. 4211-8 et L. 4211-9.

III. – Les peines mentionnées aux I et II sont portées à sept ans d’emprisonnement et 750 000 € d’amende, lorsque :

1° Les délits prévus au premier alinéa ont été commis en bande organisée ;

2° Ces mêmes délits ont été commis sur un réseau de télécommunication à destination d’un public non déterminé ;

3° Ces mêmes délits ont été commis par des établissements pharmaceutiques autorisés conformément à l’article L. 5124-3, des courtiers déclarés conformément à l’article L. 5124-20, des pharmaciens d’officine titulaires de la licence mentionnée à l’article L. 5125-4 et des pharmaciens à usage intérieur mentionnés à l’article L. 5126-5 du même code.
