Article L5426-2 of the French Public Health Code

The following constitutes a breach subject to a financial penalty:

1° Distributing or transferring gene therapy preparations or xenogenic cell therapy preparations, whether free of charge or for consideration, without authorisation or when the authorisation is suspended or withdrawn;

2° Preparing, storing, distributing, transferring, importing or exporting gene therapy preparations or xenogenic cell therapy preparations without complying with the rules of good practice defined in the decisions or orders issued pursuant to Article L. 5121-5;

3° Importing or exporting gene therapy preparations or xenogenic cell therapy preparations without the authorisation referred to in article L. 5124-13;

4° Preparing, storing, distributing, transferring, importing or exporting these products without holding the authorisations referred to in articles L. 4211-8 and L. 4211-9.

Article L5426-2

Constitue un manquement soumis à sanction financière :

1° Le fait de distribuer ou céder à titre gratuit ou onéreux des préparations de thérapie génique ou des préparations de thérapie cellulaire xénogénique sans autorisation ou lorsque l’autorisation est suspendue ou retirée ;

2° Le fait de préparer, de conserver, de distribuer, de céder, d’importer et d’exporter des préparations de thérapie génique ou des préparations de thérapie cellulaire xénogénique sans respecter les règles de bonnes pratiques définies dans le cadre des décisions ou arrêtés pris en application de l’article L. 5121-5 ;

3° Le fait d’importer ou d’exporter des préparations de thérapie génique ou des préparations de thérapie cellulaire xénogénique sans l’autorisation mentionnée à l’article L. 5124-13 ;

4° Le fait de préparer, de conserver, de distribuer, de céder, d’importer ou d’exporter ces mêmes produits sans être titulaire des autorisations prévues aux articles L. 4211-8 et L. 4211-9.
