Article L5431-6 of the French Public Health Code

The person responsible, as determined by Article 4 of Regulation (EC) No 1223/2009 of the European Parliament and of the Council of 30 November 2009 on cosmetic products, shall be liable to one year’s imprisonment and a fine of 15,000 euros for:

1° Placing a cosmetic product on the market, whether free of charge or against payment, without making the information file provided for in paragraph 1 of Article 11 of the same regulation available to the control authorities mentioned in Article L. 5431-1, at the address indicated on the labelling of this product;

2° Placing a cosmetic product on the market, whether free of charge or for consideration, without the information file referred to in Article 11 of the said Regulation containing the compulsory particulars provided for in paragraph 2 of the same Article.

Article L5431-6

Est puni d’un an d’emprisonnement et de 15 000 euros d’amende le fait pour la personne responsable, déterminée par l’article 4 du règlement (CE) n° 1223/2009 du Parlement européen et du Conseil, du 30 novembre 2009, relatif aux produits cosmétiques :

1° De mettre sur le marché à titre gratuit ou onéreux un produit cosmétique sans tenir à disposition des autorités de contrôle mentionnées à l’article L. 5431-1, à l’adresse indiquée sur l’étiquetage de ce produit, le dossier d’information prévu au paragraphe 1 de l’article 11 du même règlement ;

2° De mettre sur le marché à titre gratuit ou onéreux un produit cosmétique sans que le dossier d’information mentionné à l’article 11 dudit règlement comporte les mentions obligatoires prévues au paragraphe 2 du même article.
