Article L5435-1 of the French Public Health Code

The sale by manufacturers and dealers in gynaecological equipment of medical devices that can be used for the voluntary interruption of pregnancy to persons who are not members of the medical profession or who do not themselves sell such devices is punishable by two years’ imprisonment and a fine of €30,000.

Natural and legal persons are also liable to the following penalties:

1° Confiscation of the medical devices seized ;

2° Prohibition from practising the profession or activity in connection with which the offence was committed, for a period not exceeding five years.

La vente, par les fabricants et négociants en appareils gynécologiques, de dispositifs médicaux utilisables pour une interruption volontaire de grossesse à des personnes n’appartenant pas au corps médical ou ne faisant pas elles-mêmes profession de vendre ces dispositifs est punie de deux ans d’emprisonnement et de 30 000 euros d’amende.

Les personnes physiques et les personnes morales encourent également les peines suivantes :

1° La confiscation des dispositifs médicaux saisis ;

2° L’interdiction d’exercer la profession ou l’activité à l’occasion de laquelle le délit a été commis, pour une durée qui ne peut excéder cinq ans.
