Article L5439-1 of the French Public Health Code

I. – Failure to comply with the conditions set out in article L. 5139-2 relating to the production, manufacture, transport, import and export, possession, supply, transfer, acquisition and use of micro-organisms and toxins included on the list provided for in article L. 5139-1 is punishable by five years’ imprisonment and a fine of €375,000.

II. – The penalties referred to in the previous paragraph are increased to seven years’ imprisonment and a fine of €750,000 when:

1° The offences referred to in the first paragraph have been committed as part of an organised gang;

2° These same offences have been committed on a telecommunications network intended for a non-specified public.

I. – Le fait de ne pas respecter les conditions mentionnées à l’article L. 5139-2 relatives à la production, à la fabrication, au transport, à l’importation et à l’exportation, à la détention, l’offre, la cession, l’acquisition et l’emploi des micro-organismes et toxines inscrits sur la liste prévue à l’article L. 5139-1 est puni de cinq ans d’emprisonnement et de 375 000 € d’amende.

II. – Les peines mentionnées à l’alinéa précédent sont portées à sept ans d’emprisonnement et 750 000 € d’amende, lorsque :

1° Les délits prévus au premier alinéa ont été commis en bande organisée ;

2° Ces mêmes délits ont été commis sur un réseau de télécommunication à destination d’un public non déterminé.
