Article L5441-5 of the French Public Health Code

Opening or operating an establishment defined in Article L. 5142-1, without the authorisation required pursuant to Articles 88 and 99 of Regulation (EU) 2019/6 of 11 December 2018 or without this having been renewed in the event of a change to the elements included in the initial authorisation, is punishable by two years’ imprisonment and a fine of €150,000.

Le fait d’ouvrir ou de faire fonctionner un établissement défini à l’article L. 5142-1, sans l’autorisation exigée en application des articles 88 et 99 du règlement (UE) 2019/6 du 11 décembre 2018 ou sans que celle-ci ait été renouvelée en cas de modification des éléments figurant dans l’autorisation initiale, est puni de deux ans d’emprisonnement et de 150 000 euros d’amende.
