Article L5442-1 of the French Public Health Code

The extemporaneous preparation or possession of veterinary medicinal products for the purpose of selling or supplying them, whether free of charge or for consideration, by any person other than those mentioned in article L. 5143-2 or those belonging to an establishment authorised to prepare them under subcontracting in accordance with the conditions set out in article L. 5143-9-1, is punishable by two years’ imprisonment and a fine of 30,000 euros.

A veterinary surgeon who runs an open pharmacy within the meaning of article L. 5143-2 is liable to the same penalty.

La préparation extemporanée ou la détention de médicaments vétérinaires pour les céder ou les délivrer, à titre gratuit ou onéreux, par toute personne autre que celles mentionnées à l’article L. 5143-2 ou que celles appartenant à un établissement autorisé pour la préparation en sous-traitance dans les conditions prévues à l’article L. 5143-9-1, est punie de deux ans d’emprisonnement et de 30 000 euros d’amende.

Le fait pour un vétérinaire de tenir officine ouverte au sens de l’article L. 5143-2 est puni de la même peine.
