Article L545-1 of the French Monetary and Financial Code

An investment service provider may use the services of tied agents, within the meaning of 29(1) of Article 4 of Directive 2014/65/EU of 15 May 2014 and who may be natural or legal persons, to provide the following investment services, for which it is authorised:

1. The reception and transmission of orders on behalf of third parties ;

2. Guaranteed or unguaranteed investment ;

3. Investment advice.

Tied agents may also promote the services provided by the investment service provider, including related services, provide advice on these services and canvass clients on behalf of the investment service provider under the conditions set out in Chapter I of Title IV of Book III.

Un prestataire de services d’investissement peut recourir aux services d’agents liés, au sens du 29 du paragraphe 1 de l’article 4 de la directive 2014/65/UE du 15 mai 2014 et qui peuvent être des personnes physiques ou des personnes morales, pour fournir les services d’investissement suivants, pour lesquels il est agréé :

1. La réception et la transmission d’ordres pour le compte de tiers ;

2. Le placement garanti ou non garanti ;

3. Le conseil en investissement.

Les agents liés peuvent également faire la promotion des services fournis, y compris les services connexes, par le prestataire de services d’investissement, fournir des conseils sur ces services et démarcher des clients pour le compte de celui-ci dans les conditions prévues au chapitre Ier du titre IV du livre III.
