Article L552-6 of the French Monetary and Financial Code

If, after having granted its approval, the Autorité des marchés financiers finds that the offer proposed to the public no longer complies with the contents of the offer document or no longer offers the guarantees provided for in Article L. 552-5, it may order that any communication concerning the offer referring to its approval be discontinued and withdraw its approval under the conditions specified in its General Regulations, either definitively or until the issuer again complies with the conditions for approval.

In the event that, after having applied for approval from the AMF or not, a person disseminates information containing inaccurate or misleading information concerning the granting of approval, its scope or its consequences, the AMF may make a public statement mentioning these facts and the persons responsible for these communications.

Si, après avoir apposé son visa, l’Autorité des marchés financiers constate que l’offre proposée au public n’est plus conforme au contenu du document d’information ou ne présente plus les garanties prévues à l’article L. 552-5, elle peut ordonner qu’il soit mis fin à toute communication concernant l’offre faisant état de son visa et retirer son visa dans les conditions précisées par son règlement général, à titre définitif ou jusqu’à ce que l’émetteur satisfasse de nouveau aux conditions du visa.


Dans le cas où, après avoir ou non sollicité un visa de l’Autorité des marchés financiers, une personne diffuse des informations comportant des indications inexactes ou trompeuses concernant la délivrance du visa, sa portée ou ses conséquences, l’Autorité des marchés financiers peut faire une déclaration publique mentionnant ces faits et les personnes responsables de ces communications.
