The companies and entities referred to in 1° of Article L. 561-45-1 shall declare to the Trade and Companies Register, through the intermediary of the body referred to in the second paragraph of Article L. 123-33 of the Commercial Code, the information relating to the beneficial owners. This information concerns the identification details and personal domicile of these beneficiaries as well as the terms and conditions of the control they exercise over the company or entity.
Only information relating to the surname, common name, pseudonym, first names, month, year of birth, country of residence and nationality of the beneficial owners, as well as the nature and extent of the beneficial interests they hold in the company or entity, is accessible to the public.
The following shall have access to all information relating to beneficial owners
1° The companies or entities mentioned in the first paragraph, solely in respect of the information they have declared ;
2° Without restriction, the following authorities within the scope of their mission:
a) The judicial authorities ;
b) The national financial intelligence unit referred to in Article L. 561-23;
c) Customs officials acting on the basis of the prerogatives conferred by the Customs Code;
d) Authorised public finance officials responsible for tax audit and collection;
e) Authorised officers of the judicial police of the national police force and the national gendarmerie, as well as customs and tax officials authorised to carry out judicial investigations pursuant to articles 28-1 and 28-2 of the Code of Criminal Procedure;
f) The supervisory authorities referred to in Article L. 561-36;
3° Persons subject to the anti-money laundering and counter terrorist financing legislation mentioned in Article L. 561-2 in the context of at least one of the due diligence measures mentioned in Articles L. 561-4-1 to L. 561-14-2.
The authorities referred to in 2° shall communicate in good time to the counterpart authorities of the Member States of the European Union, on their own initiative or on request, the information referred to in the first paragraph necessary for the performance of the duties of these authorities.
Access to information relating to beneficial owners shall be free of charge, regardless of the means by which such information is consulted or communicated.
