Article L572-10 of the French Monetary and Financial Code

Failure by the directors of a payment institution to request the appointment of the institution’s statutory auditors or to convene them to any general meeting is punishable by two years’ imprisonment and a fine of €30,000.

Any manager of a payment institution, or any person in the service of the institution, who obstructs the statutory auditors’ checks or controls or refuses to allow them access to all documents required for the performance of their duties, and in particular all contracts, books, accounting documents and minute books, is liable to five years’ imprisonment and a fine of €75,000.

Le fait, pour les dirigeants d’un établissement de paiement de ne pas provoquer la désignation des commissaires aux comptes de l’établissement ou de ne pas les convoquer à toute assemblée générale est puni de deux ans d’emprisonnement et de 30 000 € d’amende.

Est puni de cinq ans d’emprisonnement et de 75 000 € d’amende, le fait, pour tout dirigeant d’un établissement de paiement, ou pour toute personne au service de l’établissement, de mettre obstacle aux vérifications ou contrôles des commissaires aux comptes ou de leur refuser la communication sur place de toutes les pièces utiles à l’exercice de leur mission, et notamment de tous contrats, livres, documents comptables et registres de procès-verbaux.
