Article L5721-5 of the French General Code of Local Authorities

The public-private association may achieve its purpose, in particular, by direct operation or by simple financial participation in companies or organisations under the same conditions as the départements or communes.

In the latter case, the terms and conditions of this participation are set by the decision establishing it.

Le syndicat mixte peut réaliser son objet notamment par voie d’exploitation directe ou par simple participation financière dans des sociétés ou organismes dans les mêmes conditions que les départements ou les communes.

Dans ce dernier cas, les modalités de cette participation sont fixées par la décision institutive.
