Article L573-8 of the French Monetary and Financial Code

Any person who fails to comply with the obligations laid down in articles L. 551-3 and L. 551-4 shall be liable to five years’ imprisonment and a fine of 18,000 euros.

Failure by the manager to comply with the provisions of article L. 551-5 is punishable by two years’ imprisonment and a fine of 9,000 euros.

Any statutory auditor, either in his own name or as a partner in a company of statutory auditors, who gives or confirms false information on the documents referred to in article L. 551-4 or fails to disclose to the public prosecutor any criminal offence of which he is aware, is liable to five years’ imprisonment and a fine of 18,000 euros.

Est puni d’un emprisonnement de cinq ans et d’une amende de 18 000 euros, le fait, pour toute personne de méconnaître les obligations prescrites aux articles L. 551-3 et L. 551-4.

Est puni d’un emprisonnement de deux ans et d’une amende de 9 000 euros le fait, pour le gestionnaire, de ne pas se conformer aux dispositions de l’article L. 551-5.

Est puni d’un emprisonnement de cinq ans et d’une amende de 18 000 euros le fait, pour le commissaire aux comptes, soit en son nom personnel, soit au titre d’associé dans une société de commissaires aux comptes, de donner ou confirmer des informations mensongères sur les documents mentionnés à l’article L. 551-4 ou de ne pas révéler au procureur de la République les faits délictueux dont il a eu connaissance.
