Article L591-2 of the French Code governing the entry and residence of foreign nationals and the right of asylum

For the application of this book in Guadeloupe, French Guiana, Martinique, Réunion, Mayotte and Saint-Pierre and Miquelon:
1° References to the prefect are replaced by references to the representative of the State in the collectivity;
2° References to the president of the departmental council are replaced by references to the president of the executive of the collectivity;
3° In article L. 521-1, the words : “and shall, under conditions laid down by decree of the Conseil d’Etat, determine the State responsible pursuant to Regulation (EU) No 604/2013 of the European Parliament and of the Council of 26 June 2013 establishing the criteria and mechanisms for determining the Member State responsible for examining an application for international protection lodged in one of the Member States by a third-country national or a stateless person, or pursuant to commitments identical to those provided for by the same Regulation” are deleted;
4° Articles L. 521-2 and L. 521-5 are not applicable;
5° 1° of Article L. 531-27 is not applicable;
6° The last paragraph of Article L. 531-41 is not applicable;
7° In Article L. 552-2, the words: “or until their effective transfer to another European State” are deleted;
8° The provisions of Title VII are not applicable;
9° The last paragraph of Article L. 581-3 is not applicable.

Article L591-2

Pour l’application du présent livre en Guadeloupe, en Guyane, en Martinique, à La Réunion, à Mayotte et à Saint-Pierre et Miquelon :
1° Les références au préfet sont remplacées par la référence au représentant de l’Etat dans la collectivité ;
2° La référence au président du conseil départemental est remplacée par la référence au président de l’exécutif de la collectivité ;
3° A l’article L. 521-1, les mots : ” et procède, dans des conditions fixées par décret en Conseil d’Etat, à la détermination de l’Etat responsable en application du règlement (UE) n° 604/2013 du Parlement européen et du Conseil, du 26 juin 2013, établissant les critères et mécanismes de détermination de l’Etat membre responsable de l’examen d’une demande de protection internationale introduite dans l’un des Etats membres par un ressortissant de pays tiers ou un apatride, ou en application d’engagements identiques à ceux prévus par le même règlement ” sont supprimés ;
4° Les articles L. 521-2 et L. 521-5 ne sont pas applicables ;
5° Le 1° de l’article L. 531-27 n’est pas applicable ;
6° Le dernier alinéa de l’article L. 531-41 n’est pas applicable ;
7° A l’article L. 552-2, les mots : ” ou jusqu’à leur transfert effectif vers un autre Etat européen ” sont supprimés ;
8° Les dispositions du titre VII ne sont pas applicables ;
9° Le dernier alinéa de l’article L. 581-3 n’est pas applicable.
