Article L592-2 of the French Code governing the entry and residence of foreign nationals and the right of asylum

For the application of the provisions of this book to Saint-Barthélemy:
1° With the exception of articles L. 511-7, L. 512-2, L. 520-1, L. 521-3, L. 521-14, L. 531-26 to L. 531-28, L. 531-30, L. 561-3, L. 561-5, L. 581-1 and L. 581-5, the words: “in France” are replaced by the words: “in Saint-Barthélemy”;
2° With the exception of Article L. 581-8 or the reference to the obligation to leave French territory, the words: “on French territory” are replaced by the words: “in Saint-Barthélemy” and the words: “French territory” are replaced by the words: “Saint-Barthélemy”;
3° References to the Prefect are replaced by references to the State representative in Saint-Barthélemy;
4° In Article L. 521-1, the words : “and proceeds, under conditions laid down by decree in the Council of State, to determine the State responsible pursuant to Regulation (EU) No 604/2013 of the European Parliament and of the Council of 26 June 2013 establishing the criteria and mechanisms for determining the Member State responsible for examining an application for international protection lodged in one of the Member States by a third-country national or a stateless person, or pursuant to commitments identical to those provided for by the same Regulation” are deleted ; <5° In article 521-11, the words : "president of the departmental council" are replaced by the words: "president of the territorial council";
6° 1° of Article L. 531-27 does not apply;
7° The last paragraph of L. 531-41 is deleted;
8° A paragraph is added to article L. 541-2 as follows:
“If the Office decides to hear the applicant outside the collectivity of Saint-Barthélemy, the applicant shall receive the necessary authorisations. “9° In Article L. 552-2, the words: “or until their effective transfer to another European State” are deleted; 10° In Articles L. 552-6 and L. 552-7, the reference to Regulation (EU) 2016/679 of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and to Law No. 78-17 of 6 January 1978 on information technology, files and freedoms is replaced by a reference to the rules in force in mainland France under Regulation (EU) 2016/679 of 27 April 2016;
11° In Article L. 552-11, the reference to Article L. 300-1 of the Construction and Housing Code is replaced by a reference to locally applicable provisions having the same purpose;
12° In Article L. 561-16, references to the Labour Code and the Construction and Housing Code are replaced by references to locally applicable provisions;
13° In Article L. 581-3:
a) In the first paragraph, after the words: “accompanied, where applicable, by a temporary work permit”, the words: “issued in compliance with the legislative and regulatory provisions applicable locally” are inserted;
b) The last paragraph is not applicable.

Article L592-2

Pour l’application des dispositions du présent livre à Saint-Barthélemy :
1° A l’exception des articles L. 511-7, L. 512-2, L. 520-1, L. 521-3, L. 521-14, L. 531-26 à L. 531-28, L. 531-30, L. 561-3, L. 561-5, L. 581-1 et L. 581-5, les mots : ” en France ” sont remplacés par les mots : ” à Saint-Barthélemy ” ;
2° A l’exception de l’article L. 581-8 ou de la référence à l’obligation de quitter le territoire français, les mots : ” sur le territoire français ” sont remplacés par les mots : ” à Saint-Barthélemy ” et les mots : ” le territoire français ” sont remplacés par les mots : ” Saint-Barthélemy ” ;
3° Les références au préfet sont remplacées par la référence au représentant de l’Etat à Saint-Barthélemy ;
4° A l’article L. 521-1, les mots : ” et procède, dans des conditions fixées par décret en Conseil d’Etat, à la détermination de l’Etat responsable en application du règlement (UE) n° 604/2013 du Parlement européen et du Conseil, du 26 juin 2013, établissant les critères et mécanismes de détermination de l’Etat membre responsable de l’examen d’une demande de protection internationale introduite dans l’un des Etats membres par un ressortissant de pays tiers ou un apatride, ou en application d’engagements identiques à ceux prévus par le même règlement ” sont supprimés ;
5° A l’article 521-11, les mots : ” président du conseil départemental ” sont remplacés par les mots : ” président du conseil territorial ” ;
6° Le 1° de l’article L. 531-27 n’est pas applicable ;
7° Le dernier alinéa de L. 531-41 est supprimé ;
8° A l’article L. 541-2, il est ajouté un alinéa ainsi rédigé :
” Si l’office décide d’entendre le demandeur hors de la collectivité de Saint-Barthélemy, celui-ci reçoit les autorisations nécessaires. ” ;
9° A l’article L. 552-2, les mots : ” ou jusqu’à leur transfert effectif vers un autre Etat européen ” sont supprimés ;
10° Aux articles L. 552-6 et L. 552-7, la référence au règlement (UE) 2016/679 du 27 avril 2016 relatif à la protection des personnes physiques à l’égard des traitements des données à caractère personnel et à la libre circulation de ces données et à la loi n° 78-17 du 6 janvier 1978 relative à l’informatique, aux fichiers et aux libertés est remplacée par la référence aux règles en vigueur en métropole en vertu du règlement (UE) 2016/679 du 27 avril 2016 ;
11° A l’article L. 552-11, la référence à l’article L. 300-1 du code de la construction et de l’habitation est remplacée par la référence aux dispositions applicables localement ayant le même objet ;
12° A l’article L. 561-16, les références au code du travail et au code de la construction et de l’habitation sont remplacées par les références aux dispositions applicables localement ;
13° A l’article L. 581-3 :
a) Au premier alinéa, après les mots : ” assorti, le cas échéant, d’une autorisation provisoire de travail “, sont insérés les mots : ” délivrée dans le respect des dispositions législatives et réglementaires applicables localement ” ;
b) Le dernier alinéa n’est pas applicable.
