Article L611-10-3 of the French Commercial code

At the request of one of the parties to the approved agreement, the president of the court, if he finds that the undertakings resulting from the agreement have not been performed, shall order the agreement to be rescinded.

Under the same conditions, the court shall order the homologated agreement to be rescinded.

The president of the court or the court that decides on the resolution of the agreement may also order the forfeiture of any payment period granted pursuant to the fifth paragraph of article L. 611-7 or the second paragraph of l’article L. 611-10-1.

Saisi par l’une des parties à l’accord constaté, le président du tribunal, s’il constate l’inexécution des engagements résultant de cet accord, prononce la résolution de celui-ci.

Dans les mêmes conditions, le tribunal prononce la résolution de l’accord homologué.

Le président du tribunal ou le tribunal qui décide la résolution de l’accord peut aussi prononcer la déchéance de tout délai de paiement accordé en application du cinquième alinéa de l’article L. 611-7 ou du second alinéa de l’article L. 611-10-1.
