Article L611-16 of the French Commercial code

Any clause which modifies the conditions for continuing a current contract by reducing the debtor’s rights or increasing his obligations solely as a result of the appointment of a mandataire ad hoc pursuant to article L. 611-3 or the opening of conciliation proceedings pursuant to article L. 611-6 or a request made to that end.

Any clause charging the debtor, solely as a result of the appointment of a mandataire ad hoc pursuant to Article L. 611-3 or the opening of conciliation proceedings pursuant to Article L. 611-6, with the fees of the counsel called upon by the creditor in the context of these proceedings for the portion exceeding the proportion fixed by order of the Minister of Justice.

A clause shall be deemed unwritten if the debtor is required to pay, solely as a result of the appointment of a mandataire ad hoc pursuant to Article L. 611-3 or the opening of conciliation proceedings pursuant to Article L. 611-6, the fees of the counsel called upon by the creditor in the context of these proceedings for the portion exceeding the proportion fixed by order of the Minister of Justice.

Est réputée non écrite toute clause qui modifie les conditions de poursuite d’un contrat en cours en diminuant les droits ou en aggravant les obligations du débiteur du seul fait de la désignation d’un mandataire ad hoc en application de l’article L. 611-3 ou de l’ouverture d’une procédure de conciliation en application de l’article L. 611-6 ou d’une demande formée à cette fin.

Est réputée non écrite toute clause mettant à la charge du débiteur, du seul fait de la désignation d’un mandataire ad hoc en application de l’article L. 611-3 ou de l’ouverture d’une procédure de conciliation en application de l’article L. 611-6, les honoraires du conseil auquel le créancier a fait appel dans le cadre de ces procédures pour la quote-part excédant la proportion fixée par arrêté du garde des sceaux, ministre de la justice.
