Article L612-13 of the French Intellectual Property Code

From the day on which the application is filed and until the day on which the documentary search prior to the report provided for in Article L. 612-14 has been commenced, the applicant may file new claims.

The option of filing new claims is open to the applicant for a utility certificate until the day on which that title is granted.

From the day of publication of the patent application pursuant to 1° of Article L. 612-21 and within a period set by regulation, any third party may send written observations on patentability, within the meaning of Articles L. 611-11 and L. 611-14, of the invention that is the subject of the said application. The Institut National de la Propriété Industrielle shall notify these observations to the applicant who, within a period set by regulation, may submit observations in response and file new claims.

Article L612-13

Du jour du dépôt de la demande et jusqu’au jour où la recherche documentaire préalable au rapport prévu à l’article L. 612-14 a été commencée, le demandeur peut déposer de nouvelles revendications.

La faculté de déposer de nouvelles revendications est ouverte au demandeur d’un certificat d’utilité jusqu’au jour de la délivrance de ce titre.

Du jour de la publication de la demande de brevet en application du 1° de l’article L. 612-21 et dans un délai fixé par voie réglementaire, tout tiers peut adresser à l’Institut national de la propriété industrielle des observations écrites sur la brevetabilité, au sens des articles L. 611-11 et L. 611-14, de l’invention objet de ladite demande. L’Institut national de la propriété industrielle notifie ces observations au demandeur qui, dans un délai fixé par voie réglementaire, peut présenter des observations en réponse et déposer de nouvelles revendications.
