I. – The Director in charge of the departments mentioned in Article L. 612-8-1 is appointed by order of the Minister for the Economy, on the recommendation of the Chairman of the College of Resolution.
Notwithstanding the rules relating to the organisation and management of the departments set out in Article L. 612-15, the Director of Resolution shall organise and manage the departments responsible for preparing the work of the Resolution College.
He reports to the Resolution College.
II. – The Director of Resolution may, under the same conditions as in the second to fourth paragraphs of Article L. 612-24, require any person mentioned in I and, where applicable, II of Article L. 613-34, as well as any person mentioned in Article L. 311-1 of the Insurance Code, to provide any information necessary for the preparation and implementation of crisis prevention and resolution measures in the banking and insurance sectors.
It may also ask the Secretary General of the Autorité de contrôle prudentiel et de résolution to gather this information by means of on-site inspections. The Director of Resolution and the Secretary General of the Autorité de contrôle prudentiel et de résolution shall agree on the conditions for the implementation of such on-site inspections.
III. – The Director of Resolution may receive delegation of powers from the College of Resolution under the conditions and within the limits set by decree in the Conseil d’Etat.
