Article L612-15 of the French Monetary and Financial Code

A Secretary General is appointed by order of the Minister for the Economy, on the recommendation of the Chairman of the Autorité de contrôle prudentiel et de résolution.

A first deputy secretary general, under the authority of the first deputy secretary general, is appointed by the chairman of the Autorité, after receiving the assent of the vice-chairman and approval by the ministers responsible for the economy, social security and mutual insurance. The first Deputy Secretary General will have insurance or banking experience that complements that of the Secretary General.

Acting on a proposal from the Secretary General, the AMF Board of Supervisors decides on the organisational principles of the departments, lays down the ethical rules applicable to staff and establishes the general framework for the recruitment and employment of staff in compliance with the provisions applicable to statutory employees and civil servants.

The Secretary General organises and directs the Authority’s departments. He may be delegated by the Chairman of the Authority to make appointments to posts in the Authority’s departments.

The Secretary General may receive a delegation of powers from the Supervisory Board, subject to conditions and limits set by decree in the Conseil d’Etat.

Article L612-15

Un secrétaire général est nommé par arrêté du ministre chargé de l’économie, sur proposition du président de l’Autorité de contrôle prudentiel et de résolution.

Un premier secrétaire général adjoint, placé sous son autorité, est nommé par le président de l’Autorité, après avis conforme du vice-président et agrément par les ministres chargés de l’économie, de la sécurité sociale et de la mutualité. Le premier secrétaire général adjoint possède une expérience en matière d’assurance ou bancaire complémentaire de celle du secrétaire général.

Sur proposition du secrétaire général, le collège de supervision de l’Autorité arrête les principes d’organisation des services, fixe les règles de déontologie applicables au personnel et établit le cadre général de recrutement et d’emploi du personnel dans le respect des dispositions applicables aux agents statutaires et aux fonctionnaires.

Le secrétaire général organise et dirige les services de l’Autorité. Il peut recevoir délégation du président de l’Autorité pour nommer aux emplois des services de l’Autorité.

Le secrétaire général peut recevoir une délégation de compétences du collège de supervision, dans des conditions et limites fixées par décret en Conseil d’Etat.
