Article L612-20 of the French Intellectual Property Code

The amount of the fees charged in connection with the filing, examination and granting of the patent as well as its maintenance in force may be reduced when the applicant belongs to one of the following categories:

-natural person;

-small or medium-sized enterprise;

-not-for-profit organisation in the teaching or research sector.

The benefit of the reduction is acquired on simple declaration. Any false declaration is established, at any time and following an adversarial procedure, by a decision of the Director of the Institut national de la propriété industrielle taken under the conditions provided for in Article L. 411-4. This decision is accompanied by an administrative fine, the amount of which may not exceed ten times the amount of the royalties that were due and the proceeds of which are paid to the National Institute of Industrial Property.

The terms of application of this Article shall be laid down by decree in the Council of State.

Article L612-20

Le montant des redevances perçues à l’occasion du dépôt, de l’examen et de la délivrance du brevet ainsi que de son maintien en vigueur peut être réduit lorsque le demandeur appartient à l’une des catégories suivantes :

-personne physique ;

-petite ou moyenne entreprise ;

-organisme à but non lucratif du secteur de l’enseignement ou de la recherche.

Le bénéfice de la réduction est acquis sur simple déclaration. Toute fausse déclaration est constatée, à tout moment et à l’issue d’une procédure contradictoire, par une décision du directeur de l’Institut national de la propriété industrielle prise dans les conditions prévues à l’article L. 411-4. Cette décision est assortie d’une amende administrative dont le montant ne peut excéder dix fois le montant des redevances qui étaient dues et dont le produit est versé à l’Institut national de la propriété industrielle.

Les modalités d’application du présent article sont fixées par décret en Conseil d’Etat.
