Article L612-4 of the French Code governing the entry and residence of foreign nationals and the right of asylum

Foreign nationals coming directly from the territory of one of the States party to the Schengen Agreement signed on 19 June 1990 may have 1° and 2° of article L. 612-3 applied to them if they cannot prove that they entered or remained in mainland France in compliance with the stipulations of paragraphs 1 and 2 of article 19, paragraph 1 of article 20 and paragraphs 1 and 2 of article 21 of the same agreement.

Article L612-4

L’étranger en provenance directe du territoire d’un des États parties à la convention signée à Schengen le 19 juin 1990 peut se voir appliquer les 1° et 2° de l’article L. 612-3 lorsqu’il ne peut justifier être entré ou s’être maintenu sur le territoire métropolitain en se conformant aux stipulations des paragraphes 1 et 2 de l’article 19, du paragraphe 1 de l’article 20 et des paragraphes 1 et 2 de l’article 21 de cette même convention.
