Article L6122-1 of the French Public Health Code

Projects relating to the creation of any healthcare establishment, the creation, conversion and grouping of healthcare activities, including alternatives to hospitalisation, and the installation of heavy equipment are subject to authorisation by the Regional Health Agency.

The list of healthcare activities and heavy equipment subject to authorisation is set by decree in the Conseil d’Etat.

Sont soumis à l’autorisation de l’agence régionale de santé les projets relatifs à la création de tout établissement de santé, la création, la conversion et le regroupement des activités de soins, y compris sous la forme d’alternatives à l’hospitalisation, et l’installation des équipements matériels lourds.

La liste des activités de soins et des équipements matériels lourds soumis à autorisation est fixée par décret en Conseil d’Etat.
