Renewal of the authorisation is subject to compliance with the conditions set out in articles L. 6122-2 and L. 6122-5.
It may also be subject to the conditions mentioned in the second paragraph of article L. 6122-7.
The holder of the authorisation sends the application for renewal of its authorisation to the Regional Health Agency no later than fourteen months before the authorisation expires.
After examining the elements mentioned in article L. 6122-2, the compatibility of the authorisation with the regional or inter-regional health plan, or if the authorisation holder refuses the consultation mentioned in article L. 6122-5, the regional health agency may order it to submit a renewal application under the conditions set out in article L. 6122-9, together with the results of the assessment mentioned in article L. 6122-5.
In the absence of an injunction one year before the expiry of the authorisation, and notwithstanding the provisions of article L. 6122-9, the authorisation is tacitly renewed. In this case, the opinion of the specialised commission of the regional conference on health and autonomy responsible for the health sector is not required.
