Article L613-2-2 of the French Intellectual Property Code

Subject to the provisions of articles L. 613-2-1 et L. 611-18, the protection conferred by a patent on a product containing or consisting of genetic information extends to any material in which the product is incorporated and in which the genetic information is contained and performs the function indicated.

This protection does not apply in the case of the adventitious or accidental presence of patented genetic information in seeds, plant propagating material, seedlings and plants or parts of plants.

Article L613-2-2

Sous réserve des dispositions des articles L. 613-2-1 et L. 611-18, la protection conférée par un brevet à un produit contenant une information génétique ou consistant en une information génétique s’étend à toute matière dans laquelle le produit est incorporé et dans laquelle l’information génétique est contenue et exerce la fonction indiquée.

Cette protection ne s’applique pas en cas de présence fortuite ou accidentelle d’une information génétique brevetée dans des semences, des matériels de multiplication des végétaux, des plants et plantes ou parties de plantes.
