Article L613-22 of the French Intellectual Property Code

1. Any owner of a patent application or patent who has not paid the annual fee provided for in Article L. 612-19 within the period prescribed by the said article.

The forfeiture takes effect on the due date of the unpaid annual fee.

It shall be established by a decision of the Director of the National Institute of Industrial Property or, at the request of the patentee or a third party, under the conditions laid down by regulation.

The decision is published and notified to the patentee.

2. Repealed.

Article L613-22

1. Est déchu de ses droits le propriétaire d’une demande de brevet ou d’un brevet qui n’a pas acquitté la redevance annuelle prévue à l’article L. 612-19 dans le délai prescrit par ledit article.

La déchéance prend effet à la date de l’échéance de la redevance annuelle non acquittée.

Elle est constatée par une décision du directeur de l’Institut national de la propriété industrielle ou, à la requête du breveté ou d’un tiers, dans les conditions fixées par voie réglementaire.

La décision est publiée et notifiée au breveté.
