Article L613-23-2 of the French Intellectual Property Code

The Director General of the Institut national de la propriété industrielle shall decide on the opposition after an adversarial procedure including an examination phase, under the conditions defined by decree in the Conseil d’Etat.

The decision of the Director General of the Institut shall have the effect of a judgment within the meaning of Article L. 111-3 of the Code of Civil Enforcement Procedures.
The decision of the Director General of the Institute has the effect of a judgement within the meaning of Article L. 111-3 of the Code of Civil Enforcement Procedures.

The opposition is deemed to have been rejected.
The opposition is deemed to be rejected if the Director General of the Institute has not given a ruling within the period, set by decree in the Conseil d’Etat, which runs from the date of the end of the investigation phase mentioned in the first paragraph.

Le directeur général de l’Institut national de la propriété industrielle statue sur l’opposition au terme d’une procédure contradictoire comprenant une phase d’instruction, dans les conditions définies par décret en Conseil d’Etat.


La décision du directeur général de l’Institut a les effets d’un jugement au sens du 6° de l’article L. 111-3 du code des procédures civiles d’exécution.


L’opposition est réputée rejetée si le directeur général de l’Institut n’a pas statué dans le délai, fixé par décret en Conseil d’Etat, qui court à compter de la date de fin de la phase d’instruction mentionnée au premier alinéa.
