Article L613-23-4 of the French Intellectual Property Code

When the Director General of the Institut national de la propriété industrielle grants the opposition on one of the grounds mentioned in Article L. 613-23-1 raised by the opponent, the patent may be:

1° revoked in whole or in part;

2° Maintained in an amended form taking into account the amendments made by the proprietor during the course of the procedure pursuant to Article L. 613-23-3.

Where the Director General of the Institute rejects the opposition, the patent is maintained as granted.

Article L613-23-4

Lorsque le directeur général de l’Institut national de la propriété industrielle fait droit à l’opposition pour l’un des motifs mentionnés à l’article L. 613-23-1 soulevé par l’opposant, le brevet peut être :

1° Révoqué en tout ou partie ;

2° Maintenu sous une forme modifiée compte tenu des modifications apportées par le titulaire en cours de procédure en application de l’article L. 613-23-3.

Lorsque le directeur général de l’Institut rejette l’opposition, le brevet est maintenu tel que délivré.
