Article L613-23-6 of the French Intellectual Property Code

The revocation decision has absolute effect. The effects of decisions ruling on opposition are retroactive to the filing date of the patent application.

Where a decision on opposition partially revokes the patent, it refers the proprietor back to the National Institute of Industrial Property to request that the patent be amended to comply with the decision. However, this request is only admissible if the decision ruling on the opposition is no longer subject to appeal.

The Director General of the Institute has the power to reject this request to amend the patent for failure to comply with the partial revocation decision.

La décision de révocation a un effet absolu. Les effets des décisions statuant sur l’opposition rétroagissent à la date de dépôt de la demande de brevet.


Lorsqu’une décision statuant sur l’opposition révoque partiellement le brevet, elle renvoie devant l’Institut national de la propriété industrielle le titulaire afin que ce dernier demande la modification du brevet pour se conformer à cette décision. Cette demande n’est toutefois recevable que si la décision statuant sur l’opposition n’est plus susceptible de recours.


Le directeur général de l’Institut a le pouvoir de rejeter cette demande de modification du brevet pour défaut de conformité à la décision de révocation partielle.
