Article L613-4 of the French Intellectual Property Code

1. It shall also be prohibited, in the absence of the consent of the owner of the patent, to deliver or offer to deliver, on French territory, to a person other than those entitled to exploit the patented invention, the means of implementation, on that territory, of that invention relating to an essential element thereof, where the third party knows or where the circumstances make it obvious that those means are suitable and intended for such implementation.

2. The provisions of 1 shall not apply where the means of implementation are products that are commonly found on the market, unless the third party incites the person to whom he delivers to commit acts prohibited by Article L. 613-3.

3. Those who perform the acts referred to in a, b and c of article L. 613-5.

Article L613-4

1. Est également interdite, à défaut de consentement du propriétaire du brevet, la livraison ou l’offre de livraison, sur le territoire français, à une personne autre que celles habilitées à exploiter l’invention brevetée, des moyens de mise en oeuvre, sur ce territoire, de cette invention se rapportant à un élément essentiel de celle-ci, lorsque le tiers sait ou lorsque les circonstances rendent évident que ces moyens sont aptes et destinés à cette mise en oeuvre.

2. Les dispositions du 1 ne sont pas applicables lorsque les moyens de mise en oeuvre sont des produits qui se trouvent couramment dans le commerce, sauf si le tiers incite la personne à qui il livre à commettre des actes interdits par l’article L. 613-3.

3. Ne sont pas considérées comme personnes habilitées à exploiter l’invention, au sens du 1, celles qui accomplissent les actes visés aux a, b et c de l’article L. 613-5.
