Article L613-5 of the French Intellectual Property Code

The rights conferred by the patent do not extend:

a) To acts performed in a private context and for non-commercial purposes;

b) To acts performed on an experimental basis which relate to the subject matter of the patented invention;

c) To the preparation of medicinal products made extemporaneously and by unit in pharmacies, on medical prescription, nor to acts concerning medicinal products so prepared ;

d) To studies and trials required with a view to obtaining a marketing authorisation for a medicinal product, as well as the acts required to carry them out and to obtain the authorisation;

d bis) To the acts required to obtain the advertising approval referred to in Article L. 5122-9 of the Public Health Code;

e) Objects intended to be launched into outer space introduced into French territory.

Article L613-5

Les droits conférés par le brevet ne s’étendent pas :

a) Aux actes accomplis dans un cadre privé et à des fins non commerciales ;

b) Aux actes accomplis à titre expérimental qui portent sur l’objet de l’invention brevetée ;

c) A la préparation de médicaments faite extemporanément et par unité dans les officines de pharmacie, sur ordonnance médicale, ni aux actes concernant les médicaments ainsi préparés ;

d) Aux études et essais requis en vue de l’obtention d’une autorisation de mise sur le marché pour un médicament, ainsi qu’aux actes nécessaires à leur réalisation et à l’obtention de l’autorisation ;

d bis) Aux actes nécessaires à l’obtention du visa de publicité mentionné à l’article L. 5122-9 du code de la santé publique ;

e) Aux objets destinés à être lancés dans l’espace extra-atmosphérique introduits sur le territoire français.
