Article L613-8 of the French Code governing the entry and residence of foreign nationals and the right of asylum

When a foreign national subject to a non-return ban issued in application of article L. 612-8 provides proof, no later than two months following the expiry of the period of voluntary departure from which he or she benefited, that he or she has complied with his or her obligation to leave French territory within the time limit set, the non-return ban is revoked.
However, by reasoned decision, the administrative authority may refuse this repeal in the light of particular circumstances relating to the situation and behaviour of the person concerned.
The procedures for establishing the date of enforcement of the obligation to leave French territory of a foreigner subject to a re-entry ban are determined by regulation.

Lorsqu’un étranger faisant l’objet d’une interdiction de retour édictée en application de l’article L. 612-8 justifie, au plus tard deux mois suivant l’expiration du délai de départ volontaire dont il a bénéficié, avoir satisfait à son obligation de quitter le territoire français dans le délai imparti, l’interdiction de retour est abrogée.
Toutefois, par décision motivée, l’autorité administrative peut refuser cette abrogation au regard de circonstances particulières tenant à la situation et au comportement de l’intéressé.
Les modalités de constat de la date d’exécution de l’obligation de quitter le territoire français de l’étranger faisant l’objet d’une interdiction de retour sont déterminées par voie réglementaire.
