Article L6132-5-1 of the French Public Health Code

Establishments belonging to the same regional hospital grouping may be authorised by the Director General of the Regional Health Agency, under conditions laid down by decree in the Conseil d’Etat, with regard to the intentions and capacities of all the establishments belonging to the grouping, to :

1° Pool their cash deposited with the State, by way of derogation from articles L. 312-2, L. 511-5 and L. 511-7 of the Monetary and Financial Code and article L. 6145-8-1 of this Code;

2° Draw up a single investment programme and a single multi-annual global financing plan by way of derogation from 4° and 5° of article L. 6143-7 ;

3° By way of derogation from Article L. 6114-1 and 1° of Article L. 6143-7, enter into a single multiannual contract of objectives and resources with the Regional Health Agency for all the establishments in the grouping.

Les établissements parties à un même groupement hospitalier de territoire peuvent être autorisés par le directeur général de l’agence régionale de santé, dans des conditions prévues par décret en Conseil d’Etat, au regard de l’intention et des capacités de l’ensemble des établissements parties, à :

1° Mettre en commun leurs disponibilités déposées auprès de l’Etat, par dérogation aux articles L. 312-2, L. 511-5 et L. 511-7 du code monétaire et financier et à l’article L. 6145-8-1 du présent code ;

2° Elaborer un programme d’investissement et un plan global de financement pluriannuel uniques par dérogation aux 4° et 5° de l’article L. 6143-7 ;

3° Conclure avec l’agence régionale de santé, par dérogation à l’article L. 6114-1 et au 1° de l’article L. 6143-7, un contrat pluriannuel d’objectifs et de moyens unique pour l’ensemble des établissements du groupement.
