Except in cases of nullity actions and by derogation from the first paragraph of Article L. 614-7, where a French-language translation has been produced under the conditions set out in the second paragraph of the same Article L. 614-7 or in the second paragraph of Article L. 614-9, such translation shall be considered authentic if the European patent application or the European patent confers in the text of the translation a less extensive protection than that conferred by the said application or by the said patent in the language in which the application was filed.
However, a revised translation may be produced at any time by the proprietor of the application or patent. However, the revised translation of the claims only takes effect when the conditions set out in the second paragraph of Article L. 614-9 have been met.
Any person who has, in good faith, begun to work an invention or has made effective and serious preparations to that end, without such working constituting an infringement of the application or patent in the text of the initial translation, may, as soon as the revised translation has taken effect, continue to work it free of charge in his business or for the needs thereof.
