Article L614-15 of the French Code governing the entry and residence of foreign nationals and the right of asylum

However, where it appears, during the course of proceedings, that the detained foreign national is likely to be released before the judge has given a ruling, the administrative authority shall inform the president of the administrative court or the designated magistrate. The appeal against the decision imposing an obligation to leave French territory is then decided in accordance with the procedure set out in articles L. 614-9 to L. 614-11 and within eight days of the administrative authority informing the court.

Les dispositions des articles L. 614-4 à L. 614-6 sont applicables à l’étranger détenu.
Toutefois, lorsqu’il apparaît, en cours d’instance, que l’étranger détenu est susceptible d’être libéré avant que le juge statue, l’autorité administrative en informe le président du tribunal administratif ou le magistrat désigné. Il est alors statué sur le recours dirigé contre la décision portant obligation de quitter le territoire français selon la procédure prévue aux articles L. 614-9 à L. 614-11 et dans un délai de huit jours à compter de l’information du tribunal par l’autorité administrative.
