Article L614-39 of the French Intellectual Property Code

A decree in the Council of State sets out:

<1° The conditions for applying the measures provided for in Articles L. 614-32 to L. 614-37;

2° The conditions under which the destruction of goods likely to infringe a patent, supplementary protection certificate or utility certificate provided for by the European regulations in force takes place, as well as the conditions for taking samples prior to the said destruction.

Article L614-39

Un décret en Conseil d’Etat fixe :

1° Les conditions d’application des mesures prévues aux articles L. 614-32 à L. 614-37 ;

2° Les conditions dans lesquelles a lieu la destruction des marchandises susceptibles de porter atteinte à un brevet, un certificat complémentaire de protection ou un certificat d’utilité prévue par la réglementation européenne en vigueur, ainsi que les conditions du prélèvement d’échantillons préalable à ladite destruction.
