Article L6143-3 of the French Public Health Code

The Director General of the Regional Health Agency will ask a public health institution to present a recovery plan, within a period of between one and three months set by the Director General, in one of the following cases:

1° When the Director General considers that the institution’s financial situation so requires;

2° When the institution is in a situation of financial imbalance that meets criteria defined by decree.

The terms and conditions of the return to equilibrium provided for in this plan give rise to the signature of an amendment to the multiannual contract of objectives and resources.

Article L6143-3

Le directeur général de l’agence régionale de santé demande à un établissement public de santé de présenter un plan de redressement, dans le délai qu’il fixe, compris entre un et trois mois, dans l’un des cas suivants :

1° Lorsqu’il estime que la situation financière de l’établissement l’exige ;

2° Lorsque l’établissement présente une situation de déséquilibre financier répondant à des critères définis par décret.

Les modalités de retour à l’équilibre prévues par ce plan donnent lieu à la signature d’un avenant au contrat pluriannuel d’objectifs et de moyens.
