The Director is appointed :
1° For university hospital centres, by decree issued on the report of the Minister for Health and the Minister for Universities and Research;
2° For regional hospital centres, by decree based on a report by the Minister of Health;
3° For the establishments mentioned in 1° of article 2 of the aforementioned law no. 86-33 of 9th January 1986, by order of the Director General of the National Management Centre, from a list containing at least three names of candidates proposed by the Director General of the Regional Health Agency, after consultation with the Chairman of the Supervisory Board.
As part of his or her appointment, the director undergoes training appropriate to his or her role, the content of which is laid down by decree.
After receiving the opinion of the Chairman of the Supervisory Board, the appointing authority may withdraw the Director’s appointment in the interests of the service and, if the Director is a member of the hospital civil service, the Director may be asked to find a new post after receiving the opinion of the relevant Joint Administrative Committee, except in the case of provisional administration as referred to in article L. 6143-3-1.
The management posts mentioned in 1° and 2° give entitlement to a pension either from the Caisse nationale de retraites des agents des collectivités locales, when they are occupied by civil servants in the hospital civil service or the local civil service, or from the code des pensions civiles et militaires de retraite, when they are occupied by civil servants, magistrates or military personnel. A Conseil d’Etat decree sets the salary index on the basis of which the pension is deducted. These same jobs also give the right to contribute to the compulsory additional public pension scheme.
