Article L6143-7-3 of the French Public Health Code

I. The chairman of the hospital medical committee is the vice-chairman of the hospital board.

II.The chairman of the hospital medical committee has the following duties and responsibilities:

1° In conjunction with the director, he/she coordinates the development and implementation of the hospital’s medical project, in accordance with the multiannual contract of objectives and resources and with the shared medical project if the hospital is part of a regional hospital grouping;

2° He/she coordinates the hospital’s medical policy;

3° In conjunction with the hospital director and after consultation with the executive board, he/she :

a) Defines the policy for continuous improvement in the quality, safety and appropriateness of care, as well as the conditions under which users are received and treated;

b) Determines the internal organisation of the hospital for clinical and medico-technical activities;

c) Signs the contracts for the clinical or medico-technical clusters mentioned in Article L. 6146-1.

4° In conjunction with the director of the hospital and, where the practitioner concerned is an armed forces practitioner, with the Minister for Defence, appoints and dismisses:

a) The heads of the clinical and medico-technical divisions. In university hospital centres, the decision is taken jointly with the director of the medical training and research unit or, if there are several units, with the president of the medical education coordination committee;

b) The heads of the internal structures, departments or functional units of the clinical and medico-technical activity clusters;

The president of the establishment’s medical commission keeps the commission regularly informed of the exercise of its missions and powers.

III. – A governance charter concluded between the establishment’s medical commission and the minister of defence, the president of the establishment’s medical commission, the president of the medical education coordination committee and the president of the medical education coordination committee.A governance charter agreed between the chair of the hospital medical committee and the director of the hospital provides in particular for:

1° The procedures for the participation of the chair of the hospital medical committee in discussions with external authorities or organisations that concern the hospital;

2° For activities falling within the remit of the hospital medical committee, the operating procedures adopted for relations between the chair of the hospital medical committee and the functional departments;

3° The material and human resources made available to the chair of the hospital medical committee to enable him/her to carry out his/her duties.

I.-Le président de la commission médicale d’établissement est le vice-président du directoire.

II.-Le président de la commission médicale d’établissement exerce les missions et les attributions suivantes :

1° Il coordonne, en lien avec le directeur, l’élaboration et la mise en œuvre du projet médical de l’établissement, en conformité avec le contrat pluriannuel d’objectifs et de moyens et avec le projet médical partagé si l’établissement est partie à un groupement hospitalier de territoire ;

2° Il coordonne la politique médicale de l’établissement ;

3° Conjointement avec le directeur de l’établissement et après concertation avec le directoire, il :

a) Définit la politique d’amélioration continue de la qualité, de la sécurité et de la pertinence des soins, ainsi que des conditions d’accueil et de prise en charge des usagers ;

b) Arrête l’organisation interne de l’établissement pour les activités cliniques et médico-techniques ;

c) Signe les contrats de pôles cliniques ou médico-techniques mentionnés à l’article L. 6146-1.

4° Conjointement avec le directeur de l’établissement et, lorsque le praticien concerné est un praticien des armées, avec le ministre de la défense, il procède à la nomination et met fin aux fonctions :

a) Des chefs pôles d’activité clinique et médico-technique. Dans les centres hospitaliers universitaires, la décision est prise conjointement avec le directeur de l’unité de formation et de recherche médicale ou, en cas de pluralité d’unités, avec le président du comité de coordination de l’enseignement médical ;

b) Des responsables des structures internes, services ou unités fonctionnelles des pôles d’activité clinique et médico-technique ;

Le président de la commission médicale d’établissement tient la commission régulièrement informée de l’exercice de ses missions et attributions.

III.-Une charte de gouvernance conclue entre le président de la commission médicale d’établissement et le directeur de l’établissement prévoit notamment :

1° Les modalités de participation du président de la commission médicale d’établissement aux échanges avec des autorités ou organismes extérieurs qui concernent l’établissement ;

2° Pour les activités relevant des compétences de la commission médicale d’établissement, les modalités de fonctionnement retenues pour les relations entre le président de la commission médicale d’établissement et les directions fonctionnelles ;

3° Les moyens matériels et humains mis à la disposition du président de la commission médicale d’établissement pour assurer ses missions.
