Article L6145-7 of the French Public Health Code

Without prejudice to the fulfilment of their missions, public health institutions may, on a subsidiary basis, provide services, develop research activities and their results and exploit patents and licences within the framework of industrial and commercial services.

University hospital centres may acquire holdings and set up subsidiaries to provide services and expertise at international level, develop research activities and their results and exploit patents and licences, under conditions and within limits set by decree in the Conseil d’Etat.

Any deficits arising from the activities mentioned in the first two paragraphs are not enforceable against the public authorities and bodies that finance the establishments.

The procedures for applying this article shall be laid down by decree.

Sans porter préjudice à l’exercice de leurs missions, les établissements publics de santé peuvent, à titre subsidiaire, assurer des prestations de service, valoriser les activités de recherche et leurs résultats et exploiter des brevets et des licences dans le cadre de services industriels et commerciaux.

Les centres hospitaliers universitaires peuvent prendre des participations et créer des filiales pour assurer des prestations de services et d’expertise au niveau international, valoriser les activités de recherche et leurs résultats et exploiter des brevets et des licences, dans des conditions et limites fixées par décret en Conseil d’Etat.

Le déficit éventuel des activités mentionnées aux deux premiers alinéas n’est pas opposable aux collectivités publiques et aux organismes qui assurent le financement des établissements.

Les modalités d’application du présent article sont fixées par décret.
