Article L615-18 of the French Intellectual Property Code

By way of derogation from the first paragraph of Article L. 615-17, the civil actions and claims referred to in the first paragraph of Article 32 of the Agreement relating to a Unified Patent Court shall be brought exclusively before the Unified Patent Court:

1° Where they relate to a European patent with unitary effect;

2° Where they relate to a European patent or a European patent application which has not been the subject of a derogation from the exclusive jurisdiction of that court pursuant to the third paragraph of Article 83 of that Agreement.

Article L615-18

Par dérogation au premier alinéa de l’article L. 615-17, les actions civiles et les demandes mentionnées au premier paragraphe de l’article 32 de l’accord relatif à une juridiction unifiée du brevet sont exclusivement portées devant la juridiction unifiée du brevet :

1° Lorsqu’elles portent sur un brevet européen à effet unitaire ;

2° Lorsqu’elles portent sur un brevet européen ou une demande de brevet européen n’ayant pas fait l’objet d’une dérogation à la compétence exclusive de cette juridiction en application du troisième paragraphe de l’article 83 de cet accord.
